Terms of Service

1. Agreement
By creating an Apex Collect account, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the service.
2. The service
Apex Collect provides automated billing outreach software that sends SMS and email messages to your clients on your behalf. You are responsible for all messages sent through your account and for ensuring your use of the service complies with applicable law.
3. Your responsibilities
You must (a) provide accurate account information; (b) keep your login credentials secure; (c) obtain proper consent from all recipients before adding them to the platform; (d) comply with the TCPA, CAN-SPAM Act, and all other applicable laws; (e) not use the service for harassment, threats, deceptive content, or any unlawful purpose.
4. Prohibited uses
You may not use Apex Collect to send unsolicited messages, contact individuals who have opted out, impersonate any person or entity, transmit malware or spam, or violate any third-party rights. We reserve the right to suspend or terminate accounts that violate these restrictions without notice.
5. SMS compliance
You acknowledge that SMS outreach is subject to carrier regulations and A2P 10DLC requirements. You are solely responsible for registering your campaign and ensuring recipient consent. Apex Collect will honor opt-out requests immediately, but you remain responsible for maintaining opt-out records and not re-adding opted-out recipients.
6. Fees and billing
Paid plans are billed monthly or annually as selected at signup. Fees are non-refundable except as required by law. We may change pricing with 30 days’ notice. Continued use after a price change constitutes acceptance.
7. Cancellation
You may cancel your account at any time from your account settings. Your access continues until the end of the current billing period. We will delete your data within 90 days of cancellation per our Privacy Policy.
8. Intellectual property
Apex Collect and its underlying technology are owned by Apex Digital. You retain ownership of your data and client information. You grant us a limited license to use your data solely to provide the service.
9. Disclaimer of warranties
The service is provided “as is” without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that messages will always be delivered.
10. Limitation of liability
To the maximum extent permitted by law, Apex Digital’s liability to you is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Your continued use after the effective date is acceptance of the updated Terms.
